Collection and Storage of personal data as well as nature and purpose of such data processing

(a)           Website

When visiting our website, an automated system collects data and information. These are stored in the log files of the server. The following data can be collected here:

–               the internet service provider of the user,

–               the IP address of the user,

–               date and time of access,

–               Websites from which the user’s system is accessed on our website (referrer),

The data of the log files are always stored separately from other personal data of the user.

(b)           Contact form

Data submitted via our contact form, including your contact details, will be stored to process your request or to be available for follow-up questions. A disclosure of this data will not take place without your prior consent, unless we are required by law or legal authority to do so.

(c)            Photographic art and film art

Insofar as the artist through its photographic works and film works records and stores photografic data relating to you, the processing of such photographic data and / or film data (including photography and / or filmography) is exclusively used for artistic purposes to create photographic art and / or film art. The legitimate and superior interest to use photographic data or film data in the arts is protected by applicable law and also in accordance with point f) of Article 6 (1) GDPR .

(d)           Exhibition

If you participate in any of our exhibitions, photos and / or videos of the exhibition will be made for the purpose of documentation and reporting. As a result, personal data relating to you may be processed. The processing of the data is based on the protection of legitimate interests of the artist in accordance with point f) of Article 6 (1) GDPR.

Right of access

If your personal data concerning you is being processed you shall have the following access to the personal data and the following information:

(a)           According to Art. 15 GDPR the right to obtain confirmation as to whether or not personal data concerning you is being processed. In particular, you shall obtain information about the purpose of the processing, the categories of personal data concerned, the categories of recipient to whom the personal data have been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing, the right to lodge a complaint, any information as to the source of your personal data, where the personal data is not collected from the data subject, as well as the existence of automated decision making including profiling and if necessary meaningful information about the logic involved as well as the significance and the envisaged consequences of such processing for the data subject;

(b)           according to Art. 16 GDPR the right to obtain without undue delay the rectification of inaccurate or incomplete personal data concerning you;

(c)            according to Art. 17 GDPR the right to obtain erasure of personal data concerning you,  unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, for the establishment, exercise or defence of legal claims;

(d)           according to Art. 18 GDPR the right to obtain restriction of processing, if and when the accuracy of the data is contested by the data subject, the processing is unlawful and the data subject opposes the erasure of the personal data and we no longer need the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims or the data subject has objected to processing pursuant Art. 21 GDPR;

(e)           according to Art. 20 GDPR the right to obtain the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller;

(f)             according to Art. 7 Abs. 3 GDPR the right to withdraw your consent to the controller at any time. As a consequence the processing of data based on consent shall not be continued thereinafter; and

(g)           according to Art. 77 GDPR the right to lodge a complaint with the supervisory authority, in particular at your habitual residence; place of work or at the seat of our company.

Right to object

According to Art. 21 GDPR you shall have the right to object, on grounds relating to your particular situation or to any direct marketing purposes, to processing of personal data concerning you which is based on legitimate interests pursuant point f) of Article 6 (1) GDPR.  Where data is being processed for direct marketing purposes no particular situation within the meaning of the law must be affirmed and the personal data shall no longer be processed thereby. Legal basis of data processing

If we obtain your consent for processing of personal data, Article 6 paragraph 1 lit. a EU General Data Protection Regulation (GDPR) shall apply.

In the processing of personal data which is required to perform a contract of which the contracting party is the data subject, Article 6 (1) lit. b GDPR serves as legal basis. This also applies to processing operations required to carry out pre-contractual actions.

If processing of personal data is required to fulfill a legal obligation to which our company is subject, Article 6 (1) lit. c GDPR applies as legal basis.

In the event that vital interests of the data subject or any other natural person require the processing of personal data, Article 6 (1) lit. d GDPR serves as legal basis.

If the processing is necessary to safeguard the legitimate interests of our company or a third party and if the interests, fundamental rights and fundamental freedoms of the data subject do not prevail over the first interest, then Article 6 (1) lit. f GDPR applies as legal basis for processing. The legitimate interest of the artist lies in the use, display, reproduction, and distribution of its artistic works.

Period of storage of personal data

Personal data is stored for the duration of the respective legal retention period. After expiry of the deadline, the data will be routinely deleted, unless there is a need to initiate a contract or to perform a contract.
